Legal Entity

ATEX Engineering Systems Private Limited is an independent legal entity incorporated under the Companies Act in India, with its own operations and product portfolio.

Partner Certification Evidence

OSNA Electronics Pvt. Ltd. is an independent manufacturing and certification partner for selected products. Partner-issued documents apply only to the products identified in those documents, and do not represent common ownership or a parent-subsidiary relationship.

Order Acceptance

All orders are subject to acceptance by ATEX Engineering Systems Private Limited. We reserve the right to decline orders that do not meet our technical specifications or export compliance requirements.

Pricing & Payment

• All prices are quoted in USD for international orders unless otherwise specified
• Prices are valid for 30 days from quotation date
• Payment terms: Advance payment or Letter of Credit as per mutual agreement
• Additional costs: Shipping, insurance, and applicable duties/taxes are customer responsibility

Delivery Terms

• Standard products: 2-3 weeks from order confirmation
• Custom engineered solutions: 4-6 weeks depending on specifications
• Delivery terms: Ex-Works (EXW) Mumbai, India unless otherwise agreed
• Force majeure events may affect delivery timelines

Product Warranties

• 18-month warranty from date of shipment or 12 months from commissioning, whichever is earlier
• Warranty covers manufacturing defects under normal operating conditions
• Excludes damage due to misuse, environmental factors, or unauthorized modifications
• Replacement, repair, or other remedy is subject to the applicable product warranty and written commercial terms

Technical Compliance

All products are designed and manufactured to meet:

• European ATEX Directive 2014/34/EU
• IECEx International Electrotechnical Commission standards
• Relevant national and regional safety standards
• Customer-specified technical requirements where applicable

Installation & Commissioning

Products must be installed by qualified personnel according to provided documentation. ATEX Engineering Systems Private Limited can provide technical guidance but installation is customer responsibility.

Liability Limitations

ATEX Engineering Systems Private Limited's liability is limited to:

• The value of the specific product or service that gave rise to the claim
• Direct damages only; no consequential, indirect, or punitive damages
• Claims must be made within 12 months of the alleged incident
• Products used within specified operating parameters and conditions

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to natural disasters, governmental actions, labor disputes, or material shortages.

Professional Use

Our products are designed for professional industrial use by qualified personnel. Customers are responsible for proper application, installation, and maintenance.

Applicable Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.

Export Compliance

International sales are subject to Indian export regulations and destination country import requirements. Customers are responsible for obtaining necessary import permits and compliance documentation.

Dispute Resolution

• Initial resolution through direct negotiation
• Mediation through recognized industrial arbitration bodies
• Final resolution through Mumbai courts if required
• English language shall be used for all legal proceedings
